Manhattan Prosecutors Drop Final Retrial on Harvey Weinstein After Accuser Jessica Mann Declares She Can No Longer Bear Testimony

Manhattan prosecutors have abandoned plans to retry Harvey Weinstein on a third-degree rape charge after the accuser, Jessica Mann, informed authorities she no longer wishes to testify in any further proceedings. This decision concludes the final unresolved criminal charge against the former Hollywood producer.

District Attorney Alvin Bragg announced Wednesday that his office will not pursue another trial on the remaining count involving Mann following a jury’s failure to reach a verdict during Weinstein’s retrial in May.

Bragg stated the decision came after prosecutors consulted with Mann, who decided she would not participate in additional trials.

“The district attorney’s office informed the court that we will not retry the remaining count of third-degree rape,” Bragg said, emphasizing this action aligns with their survivor-centered approach to prosecutions.

Prosecutors described the case as an “extraordinarily taxing ordeal” for Mann, noting she testified before two grand juries and three trial juries over eight years. They thanked her for her honesty and courage throughout the legal process.

In a statement submitted to the court, Mann explained: “It was clear to me at this last trial I could no longer endure going through this any longer.” She added that the experience has nearly stolen a decade of her life and caused more harm than good. Mann said the ordeal changed her “in irrevocable ways” with personal costs she described as having “no restitution.”

Weinstein’s spokesman Juda Engelmayer welcomed the decision, stating: “Harvey is relieved by today’s outcome.” He argued that the result should have been reached from the outset if the grand jury had been presented with the full scope of emails, text messages, and other private communications.

The rape charge remained unresolved after jurors convicted Weinstein on one count of criminal sexual act and acquitted him on another during his May retrial but could not reach a unanimous verdict on Mann’s allegation.

Weinstein, 74, has consistently denied sexually assaulting anyone and maintains that all encounters were consensual.

The retrial was ordered after New York’s highest court overturned Weinstein’s landmark 2020 conviction in 2024, finding that testimony from women whose allegations were not part of the criminal charges should not have been admitted.
