Senate Can Vote on Voter ID Law Without Eliminating Filibuster, Chip Roy Argues

Rep. Chip Roy, R-Texas, wrote U.S. senators on Monday urging Majority Leader John Thune, R-South Dakota, to bring the Safeguarding American Voter Eligibility (SAVE) America Act to a floor vote without abolishing the filibuster.

The legislation passed the House 218-213 with one Democrat, Texas Rep. Henry Cuellar, voting in support, requiring documentary proof of U.S. citizenship for federal election registration and voter identification at the ballot box. Despite broad Republican backing, the bill has stalled in the Senate.

Roy argued that Thune possesses the authority to “put the bill on the floor any time,” rejecting claims that reforming or eliminating the filibuster is necessary to advance it. Roy distinguished between a real filibuster and what he termed a “fake” or “zombie” filibuster, explaining that under Senate rules, if a quorum remains without debate, the chamber must eventually proceed to a vote.

In practice, Roy noted that Republicans often allow bill discussions to continue before moving to a cloture vote to end debate. When such votes fail, the Senate typically defaults to a quorum call rather than compelling minority members to speak continuously. Roy contended Thune could instead maintain the Senate in session, requiring Democrats to physically engage in speaking to delay the SAVE America Act while Republicans remain united and present. This approach would demand discipline from Republicans, including tabling amendments and enforcing the Senate’s “two-speech rule” to prevent extended stalling tactics.

The push comes as Democrats intensify concerns that the bill could disenfranchise voters whose legal names differ from those on birth certificates, such as married women. Roy defended the legislation in a recent interview, emphasizing its flexibility through an affidavit option under penalty of perjury for documentation challenges. He also accused Democrats of deliberately misleading the public by claiming opposition to common-sense safeguards stems from a desire to allow noncitizens to vote—a practice already illegal.

Supporters argue that the current system relies too heavily on the honor system, and the SAVE America Act would provide meaningful enforcement and strengthen election integrity.
