House Unanimously Repeals Law Allowing Senators to Sue Over Phone Records from Trump’s Jan. 6 Investigation

On Thursday, the House voted unanimously to repeal legislation that permitted senators to sue the federal government for up to $500,000 in damages over phone toll records accessed during former Special Counsel Jack Smith’s January 6 investigation of President Donald Trump. The provision being repealed, known as the “spy clause,” originated from a Senate amendment approved in November within a government funding bill. This amendment enabled senators to initiate lawsuits against the federal government when their official phone records were obtained without prior notification—a move that followed Republican backlash over former Special Counsel Jack Smith’s gathering of legislative metadata during his “Arctic Frost” inquiry. House Republicans strongly condemned the Senate’s Republican faction for including the lawsuit provision in the spending bill, labeling it “self-serving” and improperly inserted without prior House consultation. Multiple House GOP leaders pledged to eliminate the provision, sparking friction among Republican lawmakers across both chambers. The repealing language is being appended to the Department of Homeland Security appropriations bill. This lawsuit provision had previously been part of a multi-bill spending package enacted by President Trump in the prior year. The vote occurs amid efforts by House leadership to finalize this year’s spending legislation, a process complicated by Democratic objections that Department of Homeland Security funding fails to sufficiently address President Trump’s mass deportation initiatives. The House has already approved eight out of twelve annual appropriations bills. Should the last four bills be passed on Thursday, they would advance to the Senate, with completion necessary before January 30 to prevent a partial government shutdown.
